Clarion launches new litigation funding package

Clarion is now offering a litigation funding and costs risk management package which offers clients a range of options designed to help them to pursue and resolve disputes without the fear of spiralling and unexpected legal costs.

Clarion is now offering a litigation funding and costs risk management package which offers clients a range of options designed to help them to pursue and resolve disputes without the fear of spiralling and unexpected legal costs. 

The most forward thinking litigation funding option on offer is a fixed fee proposal, with the firm providing a fixed quote for the whole or each stage of the litigation process.  The funding package also includes conditional fee arrangements (with the payment of Clarion’s costs partially or entirely dependent on the outcome of the litigation) and third party funding (a third party paying the litigation costs in return for a share of the damages recovered).

In addition, Clarion has joined forces with FirstAssist Legal Protection to launch an After the Event (ATE) insurance service which means that clients can be insured against an adverse costs award without actually having to pay a premium upfront.  The premium is only payable if the case is won and is then recoverable from the other side.  Under the agreement with FirstAssist, Clarion is able to place cases on cover itself, so there is no delay in cases being approved for ATE insurance. 

“Even when the law is on their side, many businesses and individuals are reluctant to pursue or defend a claim because of the expense of the litigation process, the risk of an adverse costs award, the uncertainty of the costs involved or a combination of these factors” explains Clarion partner Simon Young who leads Clarion’s dispute resolution team.  “We have surveyed the market place to find out what businesses and individuals want as far as litigation funding is concerned and the one thing that most people want is costs certainty.  In response to this, we have developed a funding package that includes the offer of fixed costs for litigation cases which will finally allow businesses to accurately budget for their litigation costs.”

Mr Young continues: “We are also the first Leeds-based firm to enter into a delegated authority scheme with ATE insurers, FirstAssist, allowing us to quickly approve cases for cover ourselves.”
