This update covers two different topics, however they both, in broad terms, relate to brand protection — your brand in relation to GDPR and your clients’ brands in relation to protecting their intellectual property.
If a company holds information relating to individuals including customers and recipients of marketing material, it will be subject to the current data protection legislation and, from 25 May 2018, the General Data Protection Regulation 2016 (GDPR). GDPR requires each business to adopt an appropriate and proportionate response to compliance and penalties for failure to comply could be significant.
GDPR requires companies to be aware of the privacy rights for individuals and the lawful grounds for processing their personal data. One basis for this is “legitimate interest”, which is an important concept for agencies to understand in order to not only ensure that their own marketing is compliant but also assist clients with marketing and media campaigns. Your clients may also be unaware that they own assets called intellectual property (“IP”) which arise automatically in the form of names, logos, packaging etc. These assets can have significant value and can be protected further through trade marks and design registrations. Our IP team will provide an introduction to the relevant IP rights, common issues which could affect your clients and how to protect their brands.
