As a matter of public policy, spouses and civil partners cannot simply agree a financial settlement between themselves at the end of their relationship. Instead, such an agreement – whatever process is engaged to reach it – has to be approved by the court and converted into a court Order for it to be considered legally binding.
Alternatively, if it is impossible for an agreement to be reached we will explore with you the best way forward for you. Issuing court proceedings, in principle, should only be taken after all other avenues have been explored. However, sometimes the situation will mean that urgent court proceedings are absolutely essential.
