Identifying Your IP
Does your business have valuable IP which it is failing to capture?
We will provide details about the basic IP rights, how they are created, who owns them, how you can protect them, how they might be exploited by the business and how they could be infringed. We'll suggest ways in which businesses can identify their IP and ensure that valuable rights are not missed or lost.
Can you be certain that your business is not infringing someone else's IP rights?
We'll suggest how you can avoid making the often costly mistake of infringing other people's IP, and what to do if you discover infringement. We'll also provide ideas on how to prevent other people from taking unfair advantage of your IP and what you can do if infringement does take place. We'll also look at steps to take to avoid consultants or ex-employees walking away with your IP or confidential information and what use they may be entitled to make of it.
Do your contracts deal with creation, ownership and exploitation of IP in a way which gives your business the appropriate rights? Do you know exact-ly what you're agreeing to in the IP clause?
We'll run through the main IP issues which arise in contracts, such as who will own IP created by an employee or a consultant, who owns deliverables and how can you change that position in a contract, the meaning and effect of warranties and indem-nities, and how to carry out an effective transfer of IP.
