Consultancy arrangements

Workers who may not fit into the limited definition of employees, such as consultants and self-employed contractors, will still have

certain rights under employment, and health and safety, legislation. We can provide you with detailed consultancy agreements to clarify the relationship between each consultant and your business. Written agreements can also help protect your confidential business information and knowledge-base through specific confidentiality and intellectual property clauses.

Problems can arise in terms of employment status, even where both parties believe the contractor or consultant to be self-employed. A court or employment tribunal will look at all of the circumstances of the relationship. If the consultant is deemed to be an employee, your business could be faced, not only with employment claims that you did not expect, but with a substantial tax bill of backdated PAYE.

With our assistance, you can understand the reality of your employment relationships, making sure that your consultants are really self-employed consultants and not your employees.
